Summary
Eelnõuga nähakse esmakordselt ette pikaajalise hoolduse mõiste. Pikaajaline hooldus tähendab hoolduse tagamist inimesele, kes vajab igapäevaelu korraldamisel abi pikema aja jooksul, kuna tema füüsilised või vaimsed võimed või töövõime on vähenenud. Pikaajaline hooldus sisaldab tervishoiuteenuseid, hooldust ja inimese igapäevast toimetulekut toetavaid teenuseid. Pikaajalise hoolduse süsteemi muudatuste esimesse etappi kuulub ka perekonnaseaduse muutmine eesmärgiga vabastada teise astme sugulased ülalpidamiskohustustest ehk edaspidi ei ole lapselaps kohustatud oma vanavanema hoolduse eest tasuma. Eelnõuga nähakse ette kohaliku omavalitsuse (KOV) üksuse õigus omal algatusel välja selgitada keskmise, raske ja sügava puude raskusastmega täisealise isiku abivajadus. KOV-i üksus võib omal algatusel välja selgitada keskmise või raske puude raskusastmega isiku võimaliku abivajaduse ning KOV-i üksus peab omal algatusel välja selgitama sügava puude raskusastmega isiku võimaliku abivajaduse. Muudatuse tulemusel on puudega inimestele paremini ja terviklikumalt tagatud vajalik abi nii riigi kui kohaliku omavalitsuse poolt. Lastekaitseseaduse muutmise üks eesmärk on luua KOV-ile õigus saada terviklik ülevaade enda piirkonnas elavatest lastest, kellele on taotletud puude raskusastet, et selgitada välja nende laste ja perede täiendav abivajadus. Varasemad analüüsid näitavad, et puudega lastel on raskusi vajaliku abi ja teenusteni jõudmisel ning tihti ei tea lapsevanem, kuhu enda murega peaks pöörduma. Muudatuse tulemusena saab KOV proaktiivselt perede poole pöörduda, pakkudes vajadusel abi ja toetavaid teenuseid, mis ennetavad abivajaduse süvenemist. Loodava süsteemi eesmärk on suurendada puudega inimeste abi saamise võimalusi ning parandada nende toimetulekut, pakkudes neile ennetavalt nõustamist ja tuge. Kuigi loodav süsteem võimaldab KOV-il puudega inimesega kui potentsiaalselt haavatavama sihtrühmaga proaktiivselt ühendust võtta, vastutab inimene oma heaolu tagamise eest eeskätt ise ja seetõttu on inimesel õigus abi vastuvõtmisest keelduda. Eelnõus on lisaks mitmeid muudatusi, mis puudutavad näiteks erihoolekandeteenuseid, KOV sotsiaaltöötaja kvalifikatsiooni, üldhooldusteenuse viibimiskoha regulatsiooni, toimetulekutoetust, seksuaalselt väärkoheldud lapsi, asendushooldust, üksi elava pensionäri toetust, vanaduspensioniealiste inimeste puude määramist.
