Summary
Eelnõuga tehtavad muudatused puudutavad elatisabi maksmist ning vanemapuhkuste ja - hüvitiste süsteemi 1. aprillil 2022 jõustuva regulatsiooni täpsustusi. Eelnõuga täiendatakse senist elatisabi määramise ja maksmise regulatsiooni pankrotimenetlusaegse elatisabi sätetega, et lapsel, kelle elatist maksma kohustatud vanema suhtes on välja kuulutatud pankrot, oleks ka pankrotimenetluse ajal võimalik saada riigilt elatisabi. Elatisabi kuni 100 eurot kuus maksab riik lapsele, kelle vanem või vanemad ei täida ülalpidamiskohustust. Kehtiva seaduse kohaselt on elatisabi võimalik taotleda nii kohtumenetluse kui täitemenetluse ajal. Probleem tekib juhul, kui võlgnikust vanema suhtes kuulutatakse välja pankrot ning algab pankrotimenetlus. Kui täitemenetlus lõpeb võlgniku pankroti väljakuulutamisega, siis see tähendab seda, et lapsel ei ole enam võimalik täitemenetlusaegset elatisabi saada. Pankrotimenetlus võib kesta kauem kui aasta ning lapsel puudub sellel perioodil õiguslik alus elatisabi saada. Kehtiv perehüvitiste seadus ei sisalda aluseid ega regulatsiooni, mis lubaks maksta elatisabi pankrotimenetluse ajal.
