Summary
Eelnõuga lahendatakse tolliseaduse rakendamisel praktikas ilmnenud kitsaskohti. Tõstetakse juriidilise isiku trahvimäärasid, mis on tolliseaduses kehtinud muutumatuna 2001. aastast alates. Trahvimäärad viiakse kooskõlla karistusseadustikus sätestatud määradega. Tollialaste õigusaktide rikkumiste eest määratavad rahatrahvid peavad olema proportsionaalsed, hoiatavad ja tõhusad. Selleks, et maksu- ja tolliameti kaalutlusruum oleks rahvusvahelise kaubandusega tegelevate ettevõtete rikkumistele reageerimisel suurem, tõstetakse näiteks tänane 3200 euro suurune trahvimäär 100 000 euroni. Rahvusvahelise kaubanduse ja kütuseäri käibed ja kasumid on suured ja maksudest hoidumisel on ka riigi kahju suur. Trahvid peavad kajastama õigusrikkumise ulatust ja võimaldama ära võtta sellest saadud kasu. Maksu- ja tolliamet teeb tollieeskirjade täitmise üle riiklikku järelevalvet ning viib läbi kuritegude kohtueelset uurimist. Praktikas on uurijatel tekkinud vajadus kasutada oma töös erivahendeid, mille kasutamist tolliseadus ette ei näe. Uurimisosakonna töö efektiivsemaks muutmiseks täiendatakse maksu- ja tolliameti erivahendite loetelu ja lisatakse loetelusse sidumisvahendid, sõiduki sundpeatamise vahend ja tehniline tõke. Lisaks antakse maksu- ja tolliameti vormiriietuse kandmise õigus ka maksu- ja tolliameti peadirektorile ning sisekaitseakadeemia töötajatele. Tänase regulatsiooni kohaselt võivad vormi kanda Sisekaitseakadeemia Finantskolledži üliõpilased, aga mitte töötajad.
