Summary

The draft resolves the bottlenecks that appeared in practice in the implementation of the Customs Act. The fine rates for legal entities, which have been unchanged in the Customs Act since 2001, will be increased. The fine rates will be brought into line with the rates stipulated in the Penal Code. Fines imposed for violations of customs legislation must be proportionate, dissuasive and effective. In order for the discretion of the Tax and Customs Board to be international higher when responding to violations by companies engaged in trade, for example, today's fine rate of 3,200 euros will be increased to 100,000 euros. The turnover and profits of international trade and fuel business are high, and the state's loss in tax avoidance is also high. Fines must reflect the scale of the offense and allow for the forfeiture of the benefits derived from it. The Tax and Customs Board carries out state supervision over the implementation of customs regulations and carries out pre-trial investigation of crimes. In practice, researchers have had to use special tools in their work, the use of which is not provided for by the Customs Act. In order to make the work of the investigation department more efficient, the list of special tools of the Tax and Customs Board will be supplemented, and binding tools, a means of forcibly stopping the vehicle and a technical barrier will be added to the list. In addition, the right to wear the uniform of the Tax and Customs Board is also granted to the Director General of the Tax and Customs Board and for employees of the Internal Defense Academy. According to today's regulation, the form can be worn by students of the Financial College of the Internal Defense Academy, but not by employees.
