Summary
Eelnõu korrastab riikliku lennunduse nõudeid, loob aluse peamiselt geograafiliste alade ja ajutiste geograafiliste alade kehtestamiseks mehitamata õhusõidukite lendamise piiramiseks ning korrastab riigikaitselisel eesmärgil õhuruumi kasutamisega seonduvaid nõudeid, samuti tagab lahtiste lasketiirude kohal ohutu lendamise madalalt (nt kuni 305 m kõrgusel) lendavatel õhusõidukitel. Eelnõuga antakse geograafilise ala kehtestamise õigus lendamise piiramiseks valitsusele ning seadusega sätestatud juhtudeks ka ajutise geograafilise ala kehtestamiseks Politsei- ja Piirivalveametile (PPA), Päästeametile, Kaitsepolitseiametile, Maksu- ja Tolliametile ning Kaitseväele kas avaliku korra või riigi julgeoleku tagamise eesmärgil, mis tuleneb asutusest ja tema ülesannetest või nende asutuste seadusest tulenevate muude ülesannete täitmiseks. Teatud juhtudel (nt tulekahju, lennuõnnetus, liiklusõnnetus, VIP isikute kaitse) tekib vajadus piirata kiiresti eelkõige mehitamata õhusõidukite lendamist, mis tähendab, et ka lennupiirangud mehitamata õhusõidukitele teatud õhuruumi osas ajutise geograafilise alana tuleb kehtestada kiiresti. Riikliku lennunduse nõuete korrastamise käigus muudetakse riikliku õhusõiduki definitsiooni ning lisatakse riikliku lennunduse, kaitselennunduse ja kaitselennunduse õhusõiduki mõisted. Võrreldes kehtiva lennundusseadusega (LennS) lisanduvad riikliku lennunduse õhusõidukite hulka ka Päästeameti, Keskkonnaameti ja Kaitsepolitseiameti õhusõidukid. Kaitselennunduse õhusõidukite hulka arvatakse ka Välisluureameti ja Kaitseliidu õhusõidukid. Samuti täpsustatakse, millised nõuded LennSist kohalduvad riiklikule lennundusele ja eraldi kaitselennundusele. Eelnõuga ei muudeta põhimõtet, mille kohaselt riiklik lennundus järgib üldjuhul tsiviillennundusele kehtestatud nõudeid (nt lennukõlblikkus, rajatised, pilootide ja meeskonnaliikmete kvalifikatsiooninõuded) ja kaitselennundus peamiselt lennundus-määrustikuga kehtestatud nõudeid. Olulise muudatusena lisatakse eelnõusse mehitamata tsiviilõhusõiduki suhtes riikliku järelevalve käigus kohaldada lubatavad meetmed (nn droonitõrje meetmed). Nimetatud meetmed on peamiselt seotud avaliku korra tagamise ja riigi julgeoleku kaitsmisega, mistõttu neid ei saa kohaldada iga juhtumi korral. Riigikaitse eesmärgil õhuruumi kasutamise regulatsioonis on olulisim muudatus LennSi täiendamine paragrahviga, millega Lennuliiklusteeninduse ASile (LLT) määratakse riigikaitselised ülesanded: tagada lennuliiklusteenuse, sidepidamis-, navigatsiooni- ja seireteenuse ning aeronavigatsioonialase teenuse osutamine. Kuidas LLT täpselt Kaitseväge aitab, pannakse paika Kaitseväe juhataja kehtestatava õhuruumi kontrolli plaaniga. Lennuohutuse tagamiseks muudetakse ka relvaseadust (RelvS), millesse lisatakse säte, et lahtise lasketiiru ja laskepaiga omanikud või valdajad peavad enne lasketiiru või -paiga kasutusele võtmist edastama Transpordiametile lasketiiru koordinaadid. See on oluline, et piloodid ja kaugpiloodid teaksid, kus sellised lasketiirud ja -paigad asuvad, et nad saaksid sellega marsruudi ja lennukõrguste valikul arvestada.
