Summary
Seaduse muutmise eesmärk on tugevdada Eesti merejulgeolekut. Eelnõuga täpsustatakse kaitseväe riikliku järelevalve ülesandeid, samuti sõjalise jõu kasutamist Eesti merealal. Eelnõuga sätestatakse kaitseväele õigus reageerida korrakaitseliste meetmetega ja vajadusel sõjalise jõuga veesõidukist või muust ujuvvahendist lähtuva elutähtsa teenuse toimepidevust tagavat taristut, samuti riigikaitseobjekti, sadamat või muud rajatist või seadmestikku ähvardava ohu korral. Kaitseväe pädevuses olevad korrakaitseülesanded Eesti merealal on praegu seotud eelkõige riigipiiri valvamisega. Lisaks merepiiri valvamisele ja kaitsele on kaitseväe vastutusel ka mereolukorrateadlikkuse loomine ja tagamine, merereostuse avastamise ja likvideerimise korraldamine ning otsingu- ja päästetööl osalemine. Edasilükkamatus olukorras reageerib kaitsevägi ka juhul, kui Eesti merealal või väikesaarel on vajalik tõrjuda vahetut ohtu isiku tervisele või elule.
