Summary
Eelnõuga täiendatakse sätteid, mis reguleerivad ühekordselt täidetavate F-gaasi mahutitega seonduvat. Keelustatakse nende edasiandmine, vahendamine, omandamine ja valdamine. Enamik ebaseaduslikest F-gaasidest turustatakse just ühekordselt täidetavates mahutites. Kehtiva seaduse alusel on äärmiselt raske leida ja karistada neid isikuid, kes veebikeskkonnas või muude kaugmüügi vahendite kaudu nimetatud mahutites F-gaase pakuvad. Ebaseadusliku turu piiramiseks on vaja rakendada tõhusamaid järelevalvemeetmeid ja mõjuvamaid karistusmäärasid. Riikliku järelevalve erimeetmena võimaldatakse teha kontrolltehinguid, mis annab Keskkonnaametile ning Maksu- ja Tolliametile rohkem võimalusi tuvastada fluoritud kasvuhoonegaasidega seotud rikkumisi. Juba turul olevate ühekordsete mahutite leidmiseks on kontrolltehinguga lihtsam tuvastada nende pakkujad ning enne lõpptarbijani jõudmist mahutid konfiskeerida. Eelnõuga tõstetakse ka karistusmäärasid. Muudetavad trahvimäärad puudutavad juriidilisi isikuid. Maksimaalne trahvimäär on edaspidi 50 000 kuni 400 000 eurot. Trahvimäärade tõstmisel lähtutakse rikkumise keskkonnamõjust ning sellest, et trahvimäärad oleksid tegevuse ärahoidmiseks piisavalt tõhusad. Tööstusheite seaduses tõstetakse samuti juriidilise isiku trahvimäärasid selliste tegevuste korral, mis võivad oluliselt mõjutada keskkonda. Maksimaalsed trahvimäärad ulatuvad edaspidi 200 000 kuni 400 000 euroni. Muudatused välisõhku ja müra reguleerivates sätetes tulenevad seaduse rakendamisel tekkinud praktilisest vajadusest.
