Summary
Kaitseministeerium on välja töötanud eelnõude paketi, mis kirjeldab elutähtsat teenust osutavas ettevõttes riigikaitselise töökohustusega töökohtade määramist ja sätestab nende üle arvestuse pidamise korra. Riigikaitseseadus näeb ette, et riigil on võimalik kõrgendatud kaitsevalmiduse või sõjaseisukorra ajal rakendada riigikaitselist töökohustust töökohtadel, mis on reeglina seotud riigikaitseülesannete, sisejulgeoleku ja põhiseadusliku korra või elutähtsa teenuse tagamisega. Riigikaitselise töökohaga kaasneb töökohustus tööandja ees ja see inimene on vabastatud mobilisatsioonist. Kehtiva õiguse järgi rakendatakse riigikaitselist töökohustust üksnes avalikus sektoris ning puudub rakendusakt, mis võimaldaks (hädaolukorra seaduse alusel) elutähtsa teenuse osutajateks määratud ettevõttes riigikaitselise töökohustusega ametikohti määrata. Ettevalmistatud eelnõude kohaselt kooskõlastab elutähtsat teenust korraldav asutus Kaitseministeeriumiga elutähtsat teenust osutava ettevõtte riigikaitseliste töökohtade arvu ning kannab ettevõte vastava personali kohta märke töötamise registrisse. Samuti peetakse vastavate tööandjate üle arvestust tsiviiltoetuse registris. Seadusemuudatus loob eeldused valitsuse määruse „Täiendavate riigikaitseliste töökohtade moodustamine elutähtsa teenuse osutaja juures, loetelu moodustamise ning muutmise ja andmete esitamise kord“ kehtestamiseks ja rakendamiseks ettevõtteid võimalikult vähe koormaval moel.
