Summary
Eelnõuga kehtestatakse sundkoormiste määramise ja täitmise kord riigikaitseliste ülesannete täitmiseks kõrgendatud kaitsevalmiduse, mobilisatsiooni, demobilisatsiooni või sõjaseisukorra ajal. Kuna riigikaitseõiguse revisjoni analüüside põhjal on justiitsministeeriumi ja kaitseministeeriumi hinnangul sundkoormiste korraldamisega seotud õigusaktide muutmine ulatuslik ja ajamahukas protsess, siis tehakse riigikaitseliste sundkoormiste seaduse muutmine kahes etapis. Praegu tehakse esmased ja eelkõige sõjalise riigikaitse korraldamise seisukohalt olulised muudatused sundkoormiste määramiseks ja nende täitmise ettevalmistamiseks. Teises etapis tehakse riigikaitseõiguse revisjoni (2017–2019) raames põhjalikumad muudatused. Eelnõu täpsustab kehtivas riigikaitseliste sundkoormiste seaduses haldusorgani ja isikute õigussuhteid sundkoormiste määramise ja täitmise korraldamisel. Eelnõuga lisatakse elutähtsa teenuse osutamiseks vältimatult vajalik vara loetelusse, mida sundkoormata ei tohi. See on elutähtsa teenuse osutajate selline vara, mida neil läheb kriisi ajal teenuse toimepidevuse tagamiseks vältimatult vaja.
