Summary
Eelnõu eesmärk on anda töötajatele kiirem ja lihtsam võimalus tööandja maksejõuetuse korral saada töötukassast maksejõuetushüvitis ning tagada õigusselgus ajutise halduri ja pankrotihalduri tasu väljamaksmise ajas ja arvestamise metoodikas. Kohtule pannakse kohustus hinnata tööandja maksejõulisust töötaja esitatud andmete põhjal juba siis, kui kohus teeb määruse pankrotiavalduse menetlusse mittevõtmise kohta. Selle määrusega saab töötaja pöörduda töötukassase maksejõuetushüvitise taotlemiseks. Varatutes pankrotimenetlustes antakse kohtutele õiguslik alus tasuda pankrotihaldurile ka tunnitasu alusel. Ühtlasi võimaldatakse ajutisel halduril esitada tasu- ja kulutuste hüvitise nõue sissemakseta osaühingu osaniku vastu.
