Summary
Seaduseelnõuga täpsustatakse vanglateenistuse töökorraldusega seotud sätteid, et vanglateenistuse tööd vajadusel säästlikumalt korraldada. See tähendab näiteks võimalust korraldada mõni vangla ülesanne keskse (konsolideeritud) struktuuriüksuse või teenistuskoha kaudu. Vangistusseadus (VangS) annab valdkonna eest vastutavale ministrile õiguse määrata ülesannete jaotus Justiitsministeeriumi ja vanglate vahel. Samas ei ole vangistusseaduses kirjeldatud pädevuste ja volituste ulatust, mida ülesannete jaotamisel arvesse võtta. Pädevusi ja volitusi saab määrusega kehtestada üksnes ulatuses, mis on seadusega ette nähtud. Seetõttu täpsustatakse muudatusega vangistusseaduse sätteid nii, et oleks selge, milline on ülesandega kaasnev pädevus, volitus ja vastutuse ulatus. Muudatused võimaldavad suurendada paindlikkust ja säästlikkust juhtimistasandite konsolideerimise abil. Eelnõuga kaasajastatakse vangistusseaduse teenistusõiguse norme. Teenistusõiguse muudatused on seotud 2015. aasta vangistusseaduse muutmise seaduse eelnõu väljatöötamiskavatsusega (VangS VTK) ja 2017. aasta avaliku teenistuse seaduse ja avaliku teenistuse eriliike reguleerivate seaduste muutmise seaduse eelnõu väljatöötamiskavatsusega. Töötasustamise põhimõtte olulisemaks muudatuseks on kahekordsest töötasust loobumine vanglaametniku puhkepäevadel töölerakendamise korral. Muudatuse tulemusel lähtutakse ka vanglaametnike puhkepäevadel töölerakendamisel avaliku teenistuse seaduses sätestatust. Lisaks kaotatakse vangistusseaduse erisused seal, kus on otstarbekam lähtuda avaliku teenistuse seaduses sätestatust. Muudatuse eesmärk on muuta vanglaametnike töötasustamine sarnasemaks teiste riigiametnike tasustamisega seal, kus erisus ei ole tingitud otseselt tööülesannete sisust.
