Summary
Eelnõu võtab üle Euroopa Liidu (EL) nõukogu direktiivi, millega hõlbustatakse liidu esindamata kodanike konsulaarkaitset kolmandates riikides. Direktiivi eesmärk on täpsustada, millal ja kuidas on väljaspool ELi asuvas riigis hättasattunud ELi kodanikel õigus saada abi teiste ELi liikmesriikide saatkondadest või konsulaatidest. Direktiivi rakendamistähtajaks on 1. mai 2018. Seaduses täpsustatakse, et EL liikmesriigi esindamata kodanikud saavad edaspidi Eesti välisesindusest konsulaarabi Eesti kodanikega samadel tingimustel. Eelnõus määratletakse, kes on esindamata kodanik. Samuti sätestatakse, et hädasolev esindamata kodanik võib esitada konsulaarabi palve Eesti välisesindusele otse, ilma kodakondsusjärgse liikmesriigi taotluseta. Samuti nähakse ette finantsmehhanism rahalise kohustuse hüvitamiseks teisele ELi liikmesriigile Eesti kodanikku hõlmava konsulaarabi juhtumi korral. Juhul, kui ELi liikmesriik annab tagatiseta rahalist abi kolmandas riigis viibivale hädasolevale Eesti kodanikule, peab hädasolija tagatiseta saadud rahalise abi Eesti riigile tagasi maksma 90 päeva jooksul tagasimaksmise nõude saamise kuupäevast. Lisaks direktiivist tulenevatele nõuetele täiendatakse seadust kahe uue konsulaarteenusega, mida konsulaarametnikud hakkavad välisesindustes osutama inimestele, kellel on vaja taastada isikutunnistuse, elamisloakaardi või digitaalse isikutunnistuse sertifikaatide kehtivus või kellele on vaja väljastada uued koodid (PIN-ümbrik), samuti hakatakse neid teenuseid pakkuma Eestisse akrediteeritud diplomaatidele, kellel on diplomaatiline isikutunnistus. Kuna eelnõu kohaselt kehtestatakse digitaalset tuvastamist ja digitaalset allkirjastamist võimaldavate sertifikaatidega seotud toimingud, mida tehakse isikut tõendavate dokumentide seaduse alusel, muudetakse ka isikut tõendavate dokumentide seadust. Juhtivkomisjoniks määrati väliskomisjon.
