Summary
Kinnisasja avalikes huvides omandamise seadus asendab kehtivat kinnisasja sundvõõrandamise seadust. Eelnõu soodustab maaomanikuga kokkuleppele jõudmist ja seeläbi kiirendab avalikes huvides rajatise valmimist. Maaomanikule nähakse ette täiendavad hüvitised, kui saadakse kokkuleppele ning kiirmenetlus väga väikeste äralõigete puhul. Lisaks saab edaspidi maaomanikule pakkuda omandamise tasu asemel erinevaid alternatiive nagu kinnisasja vahetamist või maakorralduse ehk kinnisasja piiride muutmise menetlust. Lisaks hüvitatakse maaomanikele asjaajamiskulu. Seletuskirjas märgitakse, et kinnisasja omandamise menetluses pakutakse kinnisasja omanikule tasu, mis koosneb kinnisasja väärtusest ja hüvitisest otseselt kaasneva varalise kahju ja saamata jääva tulu eest. Tasule lisanduvad täiendavad hüvitised. Kui saavutatakse kokkulepe, lisandub motivatsioonitasu 20 protsenti, kuid mitte vähem kui 0,8-kordse ja mitte rohkem, kui 50-kordse eelmise aasta keskmise brutopalga suurus. Kui avalikes huvides tuleb omandada elamiseks kasutatav hoone või eluruum, nähakse eluaseme kaotuse eest ette täiendav hüvitis kaasneva emotsionaalse kahju korvamiseks, mis on 10 protsenti tasust. Samuti nähakse igale menetlusosalisele ette hüvitis asjaajamise eest. Väga väikeste lõigete korral tehakse pakkumine kiirmenetluseks, mille käigus hindamist läbi ei viida ja tasu on fikseeritud ning seotud 0,3-kordse keskmise brutokuupalgaga (praegu 355 eurot), millele lisandub motivatsioonitasu. Eelnõu kohaselt on ette nähtud ka alternatiivid. Kinnisasjade vahetamisel lähtutakse põhimõttest, et vahetatavad kinnisasjad peavad olema oma kasutusotstarbelt sarnased ning asuma sarnases turupiirkonnas. Maakorralduse käigus muudetakse omanike kokkuleppel kinnisasjade piire. Kuna ümberkruntimine võimaldab lahendada ka maakasutuse probleeme näiteks uute maanteede või raudteede puhul ning aitab vältida maakasutuse killustumist, ribasust ja kiildumist, aitab see kaasa maaomanikega kokkulepete saavutamisele, mis lubab vältida sundvõõrandamist. Maakorraldusega kaasneva maa väärtuste vahe hüvitavad osalised. Kui kinnisasja omanikuga kokkulepet ei saavutata, teeb valdkonna eest vastutav minister või kohaliku omavalitsuse üksus sundvõõrandamise otsuse. Lähtutakse eelnevas menetluses välja selgitatud tasust.
