Summary
Eelnõuga tehakse riigihangete seaduses muudatused, mis võimaldavad rakendada ELi kehtestatud sanktsioone. ELi sanktsiooni järgi on keelatud sõlmida hankelepingut või hankelepingu täitmist jätkata isikuga, kes on Vene Föderatsiooni kodanik, resident või seal asutatud ettevõtja. Eelnõuga nähakse ette, et hankijal on õigus nõuda riigihankes osalevatelt ettevõtetelt kinnitusi, andmeid ja tõendeid, et kontrollida rahvusvahelise sanktsiooni puudumist. Teiseks muudetakse kõrvaldamise ja pakkumuse tagasi lükkamise alust selliselt, et hõlmatud oleksid ka võimalikud sanktsioonid. Kolmandaks võimaldatakse juba sõlmitud hankelepingud, kus on osalisteks rahvusvahelise sanktsiooni subjektid, ennetähtaegselt erakorraliselt lõpetada. Seaduse jõustumine on kavandatud 1. juunile 2022.
