Summary
Seaduse muutmisega vähendatakse looduskaitse bürokraatiat ja halduskoormust. Eelnõuga tehakse erandeid looduskaitselistes piirangutes riigikaitse eesmärkide täitmiseks. Eelnõu on seotud Euroopa Komisjoni algatatud rikkumismenetlusega, milles heidetakse ette, et Eesti ei ole täitnud kõiki elupaikade direktiivist tulenevaid kohustusi, sealhulgas ei ole kaitsekorralduskavad ja neis esitatud kaitse- eesmärgid ja meetmed piisavalt üksikasjalikud. Eelnõu on väljatöötatud looduskaitseseaduse muutmise eelnõu I etapp. Eelnõu järgi saab üksnes Keskkonnaamet teha ettepaneku loodusobjekti kaitse alla võtmiseks, praegu on see võimalus igaühel. Looduskaitse alla võtmise menetlus ja ekspertiis on ressursimahukas ning seda saab jätkuvalt algatada üksnes kliimaministeerium. Samuti nähakse ette, et loodusele tekitatud kahju hüvitus- või leevendusalad määrab tulevikus ekspertide asemel Keskkonnaamet. Lõplik otsus nende üle tehakse tegevusloa andmise või planeeringu kehtestamisega. Seadusesse lisatakse tingimus, et riik ei omanda kinnisasja, mille puhul oli isikule juba omandamise hetkel teada, et see kavandatakse looduskaitse alla võtta. Kui aga kaitsekord läheb hiljem rangemaks, siis kinnisasi omandatakse, aga hüvitis on pool selle väärtusest. Praegu riik kinnisasja väärtuse määramisel sellist teadlikkuse aspekti ei arvesta. Eelnõuga nähakse ka kohalikule omavalitsusele ette alus kohaliku kaitse alla võetud loodusobjekti sisaldava kinnisasja omandamiseks. Eelnõu kohaselt vähendatakse ranna ja kalda üleujutusaladel ehituskeeluvööndi (EKV) ulatust. Eelnõu kohaselt vähendatakse ehituskeeluvööndi (EKV) ulatust ranna ja kalda üleujutusohuga ala piirist. Praegu lisatakse rannaaladel üleujutusala piirile veel 200 või 100 meetrit, kuhu ei tohi ehitada. Edaspidi laieneb ehituskeeld üleujutusala piirist rannaaladel 50 meetrit ja siseveekogudel 25 meetrit. Eelnõu järgi tekib võimalus, et riigikaitse seisukohalt olulistel aladel ei pea keskkonnaameti loal looduskaitselisi töid alati tegema. Riigikaitse põhjustel võib näiteks loobuda sookoosluste taastamisest, kui sel pole olulist mõju looduskaitsele ja looduskahju saab leevendada muul moel. Kõrgendatud kaitsevalmiduse, mobilisatsiooni, demobilisatsiooni, erakorralise seisukorra või sõjaseisukorra ajal võib ehituskeeluvööndisse rajada ehitisi ilma keskkonnaameti nõusolekuta. Eelnõuga tehakse ka muid muudatusi, näiteks võib kaitse-eeskirjaga lubada sihtkaitsevööndis tee või tehnovõrgu ja -rajatise rajamist, mis hetkel võimalik kaitseala või riigikaitse tarbeks; lindude ja nahkhiirte rõngaid on seni väljastatud riigi kulul, see muutub tasuliseks; jahiluba saab hakata väljastama ka elektrooniliselt; täpsustatakse keelatud tegevusi, mis põhjustavad looduses võõrliikide arvukuse suurenemist või leviku laienemist ja abitute loomade puhul lähtub Keskkonnaamet nende aitamisel liigi seisundist.
