Summary
Eelnõuga soovitakse täpsustada põhimakseteenuse regulatsiooni, finantsvaldkonnaga seotud väärteo- ja järelevalvemenetluse pädevusi ning riigilõivu sularahas tasumist, samuti sätestada elutähtsa teenuse osutajatele kohustus pakkuda hädaolukorras võrguühenduseta kaardipõhiseid makseid. Seadust muudetakse, et inimesed saaksid eelkõige hädaolukordades kasutada pangakaarti ka juhul kui internetiteenus on katkenud. Seda saab teha elutähtsa teenuse osutajateks valitud poodides, tanklates ja apteekides. Selleks peavad elutähtsa teenuse osutajateks valitud pangad hakkama klientidele pakkuma ka võrguühenduseta kaardimakse võimalust. Pank peab kliendi pangakaardi kiibile seadma sisse võrguühenduseta individuaalse limiidi ning kaupmeeste makseterminalid peavad suutma läbi viia võrguühenduseta kaardimakseid. See tagab, et inimesed saavad kriitiliselt olulisi esmatarbekaupu osta ka siis, kui kaupmehe makseterminal tõrgub ega ole ühenduses panga maksesüsteemiga. Eestis on elutähtsa teenuse osutajaks fikseeritud viis panka: AS SEB Pank; Swedbank AS; Luminor Bank AS; AS LHV Pank ning Coop Pank AS. Samuti on määratud ETO kütusemüüjad, keda on kuus: AS Alexela, Olerex, Circle-K, Neste Eesti AS, Terminal, Premium 7, Jetoil. Toidupoodide ja apteekide osas pole elutähtsa teenuse osutajaid veel valitud. Teise olulise muudatusena muudetakse eraisiku põhimaksekonto avamise ja sulgemise regulatsiooni. Sätestatakse selged alused, millistel juhtudel saab pank tarbijaga sõlmitud pangakonto sulgeda. Näiteks on see võimalik rahapesu põhjendatud kahtluse korral või kui tarbija on kasutanud kontot ebaseaduslikuks tegevuseks. Muu hulgas täpsustakse riigilõivude sularahas maksmist. Asutus, kellele riigilõivu makstakse, võib otsustada, et seda saab sularahas teha ka suuremas summas kui 10 eurot.
