Summary
Eelnõuga võetakse Eesti õigusesse üle ELi direktiiv, mis käsitleb viie põhilise õhusaasteaine heitkoguste vähendamise riiklikke kohustusi. Direktiiviga on aastateks 2020 ja 2030 kehtestatud riiklikud saasteainete heitkoguste vähendamise kohustused ning teatavate õhusaasteainete heitkoguste vähendamise riikliku programmi nõuded. Programmis seatakse õhusaasteainete vähendamise eesmärgid ja meetmed, mis on riigile kohustuslikud. Saasteained, mida direktiiv käsitleb on: vääveldioksiid, lämmastikoksiidid, eriti peened osakesed, ammoniaak ja mittemetaansed lenduvad orgaanilised ühendid. Nende ainete vähendamine õhusaastes parandab välisõhu kvaliteeti ning toob kaasa positiivse mõju nii ökosüsteemidele kui elu- ja looduskeskkonnale. Ülevõetava direktiiviga kutsutakse üles tugevdama riikidevahelist koostööd saasteainete heitkoguste vähendamisel. Muu hulgas peavad riigid hakkama hindama tõenäosust, kuidas riigisisesed heiteallikad mõjutavad õhukvaliteeti nii riigis kui naaberriikides ning kirjeldama heitkoguste vähendamise meetmeid. Samuti tuleb tagada programmi kooskõla teiste asjakohaste kavade ja programmidega. Siiani on olnud programmi sisu paljuski riikide enda sisustada. Direktiiv on piirkoguste täitmise seisukohast üsna paindlik ning võimaldab riigil kombineerida erinevaid meetmeid vastavalt vajadusele ja võimalustele, kui peaks selguma oht, et heitkoguste vähendamise kohustused võiksid jääda mingitel põhjustel täitmata. Näiteks ühe meetmena võib olukorras, mil teatud aastal erakordselt külma talve tõttu ei suuda riik oma heitkoguste vähendamise kohustusi täita, kohustuste täitmiseks kõnealuse aasta heitkogused esitada kolme aasta keskmisena. Kolme aasta keskmine heitkogus arvutatakse kõnealuse aasta, sellele eelneva ja sellele järgneva aasta põhjal. Paindlikkusmeetmete rakendamisel tuleb Euroopa Komisjoni sellest teavitada. Esimene riikliku õhusaasteainete vähendamise programm tuleb Euroopa Komisjonile esitada 2019. aasta 1. aprilliks ning selle peab üle vaatama vähemalt iga nelja aasta järel.
