Summary

With the draft, the EU directive, which deals with national obligations to reduce emissions of five basic air pollutants, will be adopted into Estonian law. The directive establishes national obligations for the reduction of pollutant emissions for the years 2020 and 2030, as well as the requirements of the national program for the reduction of emissions of certain air pollutants. The program sets the goals and measures for reducing air pollutants, which are mandatory for the state. Pollutants that the directive addresses are: sulfur dioxide, nitrogen oxides, extra fine particles, ammonia and non-methane volatile organic compounds. The reduction of these substances in air pollution improves the quality of the outdoor air and leads to a positive effect on ecosystems as well as the living and natural environment. The directive to be adopted calls for strengthening cooperation between countries in reducing pollutant emissions. Among other things, countries must start evaluating the likelihood of how domestic emission sources affect air quality both in the country and in neighboring countries and to describe emission reduction measures. Consistency of the program with other relevant plans and programs must also be ensured. Until now, the content of the program has largely been the content of the countries themselves. The directive is quite flexible from the point of view of fulfilling the limit quantities and allows the state to combine different measures according to the need and possibilities, if there is a risk that the obligations to reduce emissions could not be fulfilled for some reason. For example, as one measure, in a situation where a country is unable to meet its emissions reduction obligations due to an exceptionally cold winter in a certain year, the emissions of that year can be presented as a three-year average to meet the obligations. The three-year average emissions are calculated based on the year in question, the year before that, and the year after that. When implementing flexibility measures, the European Commission must be informed about it. The first national air pollution reduction program must be submitted to the European Commission by April 1, 2019, and must be reviewed at least every four years.
