Summary
Eelnõu muudatused lahendavad praktikas kerkinud probleeme korteriomandeid ja korteriühistuid puudutavates küsimustes. Eelnõu näeb ette, et korteriomandite moodustamise tehing kinnisasja omaniku poolt peab edaspidi olema notariaalselt tõendatud. Kehtiva õiguse järgi on näiteks arendajal võimalik esitada korteriomandite moodustamise avaldus kinnistuportaalis, tulevikus tuleb selline tehing tõestada notariaalselt. Muudatusega võimaldatakse kuni kümne korteriga korteriühistutel teha raamatupidamist kassapõhiselt. Kaob kohustus esitada majandusaasta aruanne. Muudatus ei kohaldu korteriühistutele, millel on valitseja. Lisaks antakse kohalikele omavalitsustele võimalus moodustada korteriomandite ja korteriühistut puudutavate vaidluste jaoks lepitusorgan, mis tegutseb lepitusseaduse alusel. Kuna kohtuvaidlused võivad kesta kaua ning olla kulukad, on lepitusorgan kiirem ja soodsam võimalus vaidluste lahendamiseks.
