Summary
Muudatusega korraldatakse ümber keskkonnatasudest laekuva raha liikumine. Edaspidi eraldatakse keskkonnatasudest riigieelarvesse laekunud rahast vastava aasta riigieelarvega kindlaks määratud osa Keskkonnaministeeriumile. Praegu laekuvad keskkonnatasud riigieelarvesse ning sealt kindlaksmääratud ulatuses sihtasutusele Keskkonnainvesteeringute Keskus (KIK). Seletuskirjas märgitakse, et keskkonnavaldkonna rahastamise maht on seejuures kavas säilitada vähemalt senises mahus. Muudetakse vaid rahastuse strateegilise planeerimise põhimõtteid, raha kasutamise korraldamist ning raha liikumist eelarveridade vahel. Seetõttu ei kaasne muudatusega osapooltele negatiivset mõju. Muudatus on vajalik, sest rahastuse mahu sätestamine 2009. aastast kehtinud tasumääradega on nüüdseks põhjendamatu ja pigem piirav. Rahastuse mahtu ei saa suuremahulisemate projektide jaoks paindlikult ette planeerida ega vajadusel ka tõsta. Muudatuse kohaselt ei sõltuks keskkonnakaitseks sihtotstarbeliselt eraldatavad summad enam keskkonnatasude laekumisest ega tasumääradest, vaid selle raha kasutamine kujundataks riigi eelarvestrateegia käigus seatud prioriteetide, keskkonnakaitse vajaduse ning pikaajalise strateegilise vaate alusel. Samuti lõpeks seaduse muudatusega olukord, kus ka Keskkonnaministeerium ja selle haldusala asutused taotlevad KIKist raha oma põhitegevuse kulude, näiteks seire, rahastamiseks. Põhitegevusi rahastatakse edaspidi otse Keskkonnaministeeriumi eelarvest. Seeläbi suureneb haldusala rahastuse läbipaistvus ning väheneb töökoormus. Eelnõuga suurendatakse keskkonnatasudest kohaliku omavalitsuse üksustele laekuva tasu osa, mis puudutab põlevkivi kaevandmaisõiguse, põlevkivi termilise töötlemise ning põlevkivi lend- ja koldetuha kõrvaldamise tasu. Samuti täiendatakse keskkonnatasude seaduse § 56 lõiget 1 selliselt, et keskkonnaprogrammi elluviimiseks eraldab Keskkonnaministeerium aastas summa, mille suurus vastab vähemalt eelmisel aastal vee erikasutusõiguse tasudest riigieelarvesse laekunud rahalisele mahule. Muudatus on tehtud seetõttu, et Keskkonnainvesteeringute Keskusesse säiliks kindel rahastus, millega keskkonnaprojekte finantseerida. Eelnõuga muudetakse ka atmosfääriõhu kaitse seadust, halduskoostöö seadust ja keskkonnaseire seadust.
