Summary
Eelnõu näeb ette muuta toetusraha tagasinõudmisel rakendatava viivise arvestamine paindlikuks ning toetuse saaja õigusi arvestavaks. Eelnõu kohaselt edaspidi Euroopa Liidu ühise põllumajanduspoliitika rakendamise seaduse alusel antud toetusraha tagasinõude ajatamise korral viivist enam ei nõuta. Selle asemel maksab toetuse saaja intressi, mis on kuue kuu euribor pluss kolm protsenti aastas. Sarnane regulatsioon kehtib ka nende toetuste tagasinõudmisel, mida antakse kalandusturu korraldamise seaduse ning struktuuritoetuste seaduste alusel. Teise muudatusena täiendatakse muudetavaid seadusi eraõiguse kohtupraktikas juurdunud põhimõttega, mille kohaselt viivist ei arvestata põhivõlgnevust ületavas osas.
