Summary

The structure and amount of state fees and charges for processing biocides permits will be changed, as well as the provisions of the law will be brought into line with Regulation (EU) No. 528/2012 of the European Parliament and of the Council (making available and using biocides on the market). The calculation of the new state fee rates is based on the hourly wage of the Health Board official based on the personnel and financial costs of 2021 and the time required for work. The average hourly wage for a chemical clerk is 19.91 euros and the general administrative cost per hour is 7.22 euros. The possible maximum hourly fee of a contracted expert is increased from 150 euros to 200 euros. In addition, technical changes are made to the Biocides Act, for example, the provisions concerning the control of harmful organisms are specified (requirement for the availability of hand sanitizer user manuals in public places, possibility to fill containers of hand sanitizers from open packaging in public places). In addition state supervision is consolidated under one office according to one type of product or intended purpose. In the case of some products, the same product is currently inspected by several agencies, for example, the Health Board inspects the effect of the product on health, the Consumer Protection and Technical Supervision Agency inspects the compliance of the product information with the requirements. The bill entails additional costs for the Health Board in connection with the change in supervisory tasks from 253,250 euros per year. The law is scheduled to enter into force in 2023 On June 1.
