Summary
Eelnõu kohaselt muudetakse kohaliku omavalitsuse ja riigi vahelised maatoimingud lihtsamaks ja läbipaistvamaks. Ühtlustatakse riigi ja KOVide maade võõrandamisel vastastikku avaliku huvi väljaselgitamise ja teostamise võimalusi ning antakse riigile õigus sekkuda avaliku huvi korral maade omandamiseks. KOVil tekib kohustus välja selgitada kinnisasja vajalikkus riigile, kui KOV hakkab võõrandama või seadma hoonestusõigust maale, mille ta on eelnevalt riigilt tasuta saanud. Riigile maa tagastamisel kompenseerib riik KOVile tema poolt kinnisasjale tehtud kasulikud kulutused, kui nendega on kinnisasja oluliselt parendatud. Eelnõu kohaselt vähendatakse KOVi poolt riigile makstavat hüvitist ja tasu nii tasuta saadud kinnisasja edasivõõrandamisel, kui ettevõtluskeskkonna arendamiseks ja elamumaaks sobiva kinnisasja võõrandamisel 65%-lt 50%-le (maa harilikust väärtusest). Sealjuures saab riigile makstavast tasust maha arvata KOVi poolt kinnisasjale tehtud kasulikud kulutused. Samuti pikendatakse ettevõtluskeskkonna arendamiseks ja elamumaaks sobiva kinnisasja võõrandamisel tasumise tähtaega viielt aastalt seitsme aastani.
