Summary
Eelnõuga luuakse alused ja tingimused eestikeelsele õppele üleminekuks. Eelnõu järgi algab üleminek eesti õppekeelele 2024/2025. õppeaastast koolieelsetes lasteasutustes ning 1. ja 4. klassis. Kutseõppeasutustes puudutab muudatus kutsekeskhariduse õppekava järgi õppivaid õpilasi. Eelnõu on väljatöötatud valitsuse tegevusprogrammi täitmiseks, mille kohaselt tuleb 1. novembriks 2022. a vastu võtta lasteaias ja põhikoolis eestikeelsele õppele ülemineku seadus tingimusega, et üleminek eestikeelsele haridusele lõpeb 2030. aastal. Eelnõuga nähakse ette ülemineku tähtajad erinevatele haridustasemetele. Kui praegu võib koolides ja koolieelsetes lasteasutustes olla õppekeeleks hoolekogu ja kohaliku omavalitsuse üksuse otsusel ka muu keel kui eesti keel, siis eelnõu seda enam ette ei näe. Eelnõu järgi võib gümnaasiumis, samuti kutsekeskhariduse õppekavade alusel läbiviidavas õppes 2024/2025. kuni 2029/2030. õppeaastani muu keele osakaal olla kuni 40 protsenti kooli õppekavas määratud õppe mahust. Koolieelsetes lasteasutustes võib õppe- ja kasvatustegevust eesti keelest erinevas keeles alates 2024/2025. õppeaastast läbi viia samuti juhul, kui valla- või linnavolikogu on taotlenud Vabariigi Valitsuselt erandi tegemist konkreetse lasteasutuse või lasteasutuse rühma kohta. Eelnõu näeb ette võimalused kasutada lisaks eesti õppekeelele muud keelt või eesti keele asemel muud keelt teatud sihtrühmade osas kui kooliväline nõustamismeeskond on selliselt soovitanud, näiteks toimetuleku- ja hooldusõppel olevate või erivajadustega õpilaste suhtes. Eelnõuga täiendatakse haridustöötajate kvalifikatsiooninõuet eesti keele oskuse nõudega, st õpetaja peab oskama eesti keelt C1-tasemel ja samal tasemel eesti keele oskus on nõutav ka haridusasutuse juhil. Keelenõuete täitmise üle teostab vastavalt oma pädevusele haldusjärelevalvet Keeleamet. Keelenõuete tõhusamaks täitmiseks tõstetakse eelnõu kohaselt sunniraha ülemmäära 9600 euroni (praegu 640 eurot). Eelnõu kohaselt jõustub seadus 2024. a 1. septembril, kuid erandi taotlemist puudutavad sätted jõustuvad aasta varem, mis võimaldab valla- või linnavolikogudel esitada taotlusi seoses 2024/2025. õppeaastast kehtima hakkavate nõuetega eestikeelseks õppeks.
