Summary
Eelnõu kaasajastab seadust, vähendab riigi funktsioone ja suurendab tootjate omavastutust. Eelnõuga lihtsustatakse seemnete sertifitseerimise süsteemi selliselt, et seemnetootjal oleks võimalus teha sertifitseeritud seemnekategooria korral põldtunnustamist, võtta kõigi seemnete sertifitseeritavate kategooriate korral proove ja neid ka analüüsida. Neil, kes soovivad teha põldtunnustamist, proovivõtmist või laboratoorset proovide analüüsimist või pakkuda eespool nimetatud teenust, peab olema majandustegevuse luba. Eelnõuga täiendatakse sordilehte reguleerivaid sätteid.Sordilehte võetavate liikide sortide hulka lisatakse puuvilja- ja marjakultuuride liikide sordid. Siiani on olnud võimalik puuvilja- ja marjakultuuri sorte registreerida, kuid sordilehte neid ei kantud. Alates 2017. aasta 1. jaanuarist hakati koostama Euroopa Liidu ühtset sortide nimekirja FRAUMATIS ning sellega seonduvalt luuaksegi võimalus puuvilja- ja marjakultuuri sordid ka Eestis sordilehte kanda. Eelnõuga muudetakse omatarbeks toodetud seemnete kohta teabe kättesaadavuse ja sordiomanikule kaitsealuse sordi kasutamise eest litsentsitasu maksmise regulatsiooni. Ehk erisusena on lubatud teatud oluliste põllukultuuride seemet toota oma tarbeks kasutamiseks, kuid ka selle eest tuleb maksta sordiomanikule tasu. Praeguse seaduse kohaselt ei saa sordiomanikud piisavalt teavet omatarbeks toodetud sortide seemnetest, samuti ei saa nad tasu sortide kasutamise eest ning sellest ajendatult ei oma ka informatsiooni ega alust oma õiguste kaitse rakendamiseks. See on viinud sordiomanike huvi langemiseni Eesti turu vastu, mistõttu ei ole Eesti turul kõige uuemaid, saagikamaid ja haiguse- ning kahjurikindlamaid sorte. Selleks, et muuta Eesti turu seisu paremuse poole ning tõsta saagikust, on vaja eelnõuga muuta sordikaitse ulatuse sätteid. Eelnõuga tõstetakse seemnete sertifitseerimisega seonduvaid riigilõive. Riigilõivu tasumisest on vabastatud need seemnetootjad, kes kasutavad eelnõuga loodavat võimalust teha asjakohase tegevusloa olemasolul ise põldtunnustamist ja võtta sertifitseeritavast seemnepartiist proove või kes kasutavad selleks asjakohast tegevusluba omava isiku teenust.
