Summary
Eelnõuga viiakse Eesti seadusandlus kooskõlla ELi direktiiviga, millega reguleeritakse teaduslikel eesmärkidel kasutatavate loomade kaitset. Eesti on Euroopa Komisjoni hinnangul direktiivi üle võtnud puudulikult ning see on kaasa toonud rikkumismenetluse. Eelnõus kavandatud seadusemuudatused puudutavad loomkatsete läbiviimist, katseloomade pidamist ning ettevõtja kohustusi selle juures. Seletuskirjas märgitakse, et Euroopa Komisjoni märkused on peaasjalikult tehnilist laadi ning käsitlevad sõnastuse, lause ülesehituse ning puudulike või ebakorrektsete väljendite kasutamisega seonduvaid kitsaskohti. Komisjon leiab, et mitme riigisisese õigusnormi sõnastus ei ole piisavalt täpne, et vastata direktiivis sätestatule. Veel tuuakse märkusena välja, et Eesti õigusaktides on osa direktiivis nimetatud mõisteid, tunnuseid ja elemente määratletud puudulikult, jäetud eraldi määratlemata või puuduvad direktiivi eesmärki toetavad selgesõnalised sisulised väljendid. Komisjon märgib, et mõnda sätet ei ole Eesti õigusesse üle võetud. Ühtlasi leiab komisjon, et direktiiviga kooskõlas olevad haldustavad, mida kirjeldavad Eesti ametiasutused oma vastuses, ei ole direktiivi ülevõtmiseks piisavad.
