Summary
Kehtiva seaduse järgi võivad kvalifitseeritud usaldusteenuse osutajad e-identimist ja e-tehinguteks vajalikke usaldusteenuseid nagu ID-kaardi, Smart-ID ja mobiil-ID-ga allkirja andmist või isiku tuvastamist pakkuda juhul, kui on sõlmitud kindlustuspakkujaga vastutuskindlustusleping. Kuna Eesti turg on väike ja kohalikele teenusepakkujatele on nišiteenuse väljaarendamine kulukas, ei pakuta Eesti turule soovitud mahus erialast vastutuskindlustust. Selleks, et teenuse osutamine kindlustuse saamata jäämise tõttu ei katkeks, on vaja ette näha alternatiiv. Eelnõuga võimaldatakse kooskõlas ELi määrusest tagada kahju hüvitamine vastutuskindlustusega samaväärse tagatisega või piisavate rahaliste vahendite olemasolu tõendamisega. Muudatus puudutab kvalifitseeritud usaldusteenuse pakkujaid. Eestis on neid praegu kaks: Guardtime OÜ ja SK ID Solutions AS.
