Summary
Eelnõuga ühtlustatakse kaubandusliku meresõidu seaduse regulatsioone rahvusvaheliste regulatsioonide ja praktikatega ning parandatakse seaduse sõnastust ja struktuuri. Muudatused loovad suurema kindluse lastiveo-, reisijaveo- ja prahilepingute osapooltele Eesti õiguse kasutamisel. Eelnõuga on kavandatud kolm suuremat muudatust. Esiteks, lastiveolepingu peatüki muudatustega viiakse seadus kooskõlla Haagi-Visby reeglitega, ühtlustades kaubandusliku meresõidu seaduse regulatsiooni rahvusvahelise praktikaga. Teiseks, seadusemuudatustega ühtlustatakse prahilepingute regulatsiooni. Kolmandaks ühtlustatakse merinõuete korral vastutuse piiramise regulatsiooni rahvusvahelise õigusega ja korrastatakse mõistete kasutamist, et need vastaksid välislepingutes kasutatud mõistetele. Samamoodi korrastatakse ja ühtlustatakse mõistekasutust muudes peatükkides nagu päästmine, reeder, reederi vastutus, või uuendatakse mõisteid, et need vastaksid merenduses kasutavatele eelisterminitele näiteks pukseerimine.
