Summary
2022. aasta 1. jaanuaril jõustunud konkurentsiseaduse muudatuste kohaselt tuleb eriseadustega reguleeritud turgudel tegutsevatel ettevõtjatel tasuda konkurentsiametile järelevalvetasu. Järelevalvetasu näol on tegemist sihtotstarbelise tasuga ning selle eesmärk ei ole täiendav maksustamine. Ettevõtjad, kelle teenuste hindasid ja tasusid kooskõlastab Konkurentsiamet, maksavad järelevalvetasu vastavalt iga võrgu- või tegevuspiirkonna või elektritootmise kohta haldusaktis märgitud müügitulule määras, milleks on 0,2 protsenti ettevõttele antud haldusaktis märgitud müügitulust. Järelevalvetasu arvutamise aluseks on kehtiva seaduse järgi iga kalendriaasta 15. juuli seisuga antud haldusakt. Muudatusega võetakse jooksva aasta asemel arvesse eelmise aasta 15. juuli seis, mis muudab järelevalvetasu suuruse ettevõtjatele paremini prognoositavaks. Parandus mõjutab reguleeritavate sektorite taristuettevõtjaid, keda on ligi 200. Seadus on planeeritud jõustuma 2024. aasta 1. jaanuaril. Seaduse jõustumine kalendriaasta jooksul pole otstarbekas, kuna tasusid arvestatakse iga kalendriaasta kohta.
