Summary
Ratifitseerimiseks esitatud seaduse eelnõu on Ukraina vastu toime pandud agressioonikuriteo eritribunali halduskomitee asutamise ja tegevusega seotud küsimusi reguleeriv Euroopa Nõukogu välisleping. Käesoleva aasta juulis leppisid Ukraina ja Euroopa Nõukogu kokku agressioonikuriteo eritribunali loomises Euroopa Nõukogu egiidi all. Eritribunal on rahvusvaheline kohus, millel on pädevus uurida ja mõista kohut Venemaa agressioonikuritegusid toime pannud isikute üle, sealhulgas Venemaa Föderatsiooni tippjuhtkonna üle ka pärast nende ametiaja lõppu. Tribunalil on õigus agressioonikuriteos süüdi mõistetud isikuid karistada vastavalt rahvusvahelisele õigusele. Eesti on osalenud eritribunali ettevalmistavas töös alates 2022. aastast, olles osa 40 riigist koosnevast tuumikgrupist, kuhu kuulusid ka Euroopa Liidu ja Euroopa Nõukogu esindajad. Tuumikgrupp lõpetas töö 2025. aasta kevadel, koostades tribunalile vajalike alusdokumentide projektid. Ukraina esitas tribunaliga seotud dokumendid Euroopa Nõukogule 14. mail 2025, mille järel Euroopa Nõukogu ministrite asekomitee (MAK) andis 24. juunil 2025 volituse allkirjastada kokkulepped tribunaliga ning asutada halduskomitee. Kokkuleppele kirjutasid alla Euroopa Nõukogu peasekretär ja Ukraina president 25. juunil 2025, ning Ukraina parlament ratifitseeris selle 15. juulil 2025. Kokkuleppes osalemine toob endaga kaasa eritribunali rahastamise kohustuse. EN-i esialgne arvestus eritribunali aastaseks kuluks on 60–70 miljonit eurot, mis jagatakse kokkuleppe osalisriikide vahel. Kokkulepe on tähtajatu ning riigi rahaline kohustus saab olema pikaajaline.
