Summary
Eelnõuga antakse intellektuaalomandiõigusega seonduvate vaidluste lahendamise ainupädevus Harju Maakohtule. Kehtivas õiguses on intellektuaalomandit puudutavate tsiviilasjade lahendamise pädevus kõigil Eesti maakohtutel, praktikas aga jõuab enamus intellektuaalomandi vaidlusi Harju Maakohtusse, mis on ka ainus kohus, kus on intellektuaalomandile spetsialiseerunud kohtunikke. Lisaks saab muudatusega Patendiamet võimaluse kasutada kaubamärkide ja tööstusdisainilahenduste puhul elektroonilist menetlust, millega soodustatakse Patendiameti ja isiku vahelist elektroonilist suhtlust. Selleks nähakse ette võimalused teabe elektrooniliseks esitamiseks ja väljastamiseks. Muudatustega lihtsustatakse ka patendivoliniku kutse omandamist vandeadvokaatidel. Kehtiva seaduse järgi peab patendivoliniku kutse soovija olema töötanud vähemalt viimased neli aastat patendivoliniku juures või patendivoliniku äriühingus. Edaspidi loetakse kutse omandamiseks nõutava staaži hulka ka advokaadibüroos tööstusomandi valdkonnas õigusteenuse osutamise aeg. Vandeadvokaatidele aga säilib nõue sooritada patendivoliniku kutseeksam.
