Summary

The bill gives Harju County Court the exclusive competence to settle disputes related to intellectual property rights. In current law, all Estonian county courts are competent to settle civil cases concerning intellectual property, but in practice, most intellectual property disputes end up in the Harju County Court, which is also the only court with judges specializing in intellectual property. In addition, with the amendment, the Patent Office will be able to use trademarks and in the case of industrial design solutions, an electronic procedure that facilitates electronic communication between the Patent Office and the person. To this end, possibilities are provided for electronic submission and issuance of information. The changes also make it easier for sworn lawyers to acquire the patent attorney's profession. According to the current law, the applicant for the patent commissioner must have worked for at least the last four years with the patent commissioner or in the patent attorney's company. From now on, the time spent providing legal services in the field of industrial property at a law firm will also be counted as part of the seniority required to acquire the profession. However, barristers are still required to pass the patent attorney's professional exam.
