Summary

The purpose of the draft law is to help victims of domestic violence to get out of the cycle of violence and to provide them with the best protection and sense of security. To this end, the grounds for applying a stay ban provided in § 44 of the Law on Law Enforcement are supplemented in such a way that, in addition to the existing grounds, the police can apply a stay ban to identify or repel a significant and heightened threat within the meaning of the Victim Assistance Act for the protection of the rights of victims of domestic violence. In the amendment § 44 of the Law on Law Enforcement is supplemented, according to which the police can apply a stay ban within the meaning of the Victim Assistance Act for the protection of the rights of a victim of domestic violence for up to 72 hours. The stay ban protocol also becomes mandatory in cases of domestic violence.
