Summary
Eelnõu muudatused näevad ette leevendada kvalifitseeritud tööjõu puudust, mis piirab Eesti ettevõtete konkurentsivõimet ja pidurdab majanduskasvu. OSKA prognooside kohaselt jääb Eestis igal aastal puudu ligikaudu 1400 tippspetsialisti ja 700 oskustöötajat, kelle vajadust ei kata Eesti haridussüsteemi lõpetajad. Olulisema muudatusega asendatakse senine lühiajalise töötamise erisus tööjõupuudusega tegevusalade erisusega. Tööjõupuudusega tegevusaladel võimaldatakse tähtajalist elamisluba töötamiseks soodsamatel tingimustel. Seaduse jõustudes ei hakata nendel tegevusaladel kohaldama piirarvu ja eraldi ei ole vaja taotleda Eesti Töötukassa luba. Palgakriteeriumiks määratakse 80% Eesti keskmisest brutokuupalgast, mis vastab paremini oskustöötajate tegelikule palgatasemele ja välistab odava tööjõu sissetoomise. Tööjõupuudusega tegevusalade loetelu koostatakse selgete kriteeriumide alusel, milles arvestatakse: OSKA tööjõuvajaduse prognoosi; tegevusala ekspordi osatähtsust ja keskmist töötasu. Praegu on erisus eelkõige suunatud töötleva tööstuse ning veonduse ja laonduse sektoritele. Loetelu kehtestab valitsus kuni viieks aastaks. Tööjõupuudusega tegevusaladel töötamiseks antavatele elamislubadele kehtestatakse aastane mahupiirang, mis sõltub majanduskeskkonnast: majanduskasvu tingimustes kuni 0,2% alalisest elanikkonnast (u 2600 luba); muudes tingimustes kuni 0,1% alalisest elanikkonnast (u 1300 luba). Majanduskasvu hindamisel lähtutakse rahandusministeeriumi jooksva aasta SKP reaalkasvu prognoosist, mis peegeldab paremini tegelikku majandusolukorda. Hinnanguliselt toob seaduse muudatus lisamaksutulu perioodil 2026–2029 aastatel orienteeruvalt 14–27 miljonit eurot aastas. Kumulatiivne maksutulu võib ulatuda 37–65 miljoni euroni aastas, kui enamik välistöötajaid jääb Eestisse pikemaks ajaks.
