Summary
Eelnõuga kiirendatakse riigikaitseks vajalike ehitiste kavandamist ja ehitamist. Muudatuste vajalikkus on tingitud julgeolekuolukorrast ning liitlaste vastuvõtmise ja riigi kaitseplaanide rakendamise vajadusest. Samuti aitab uus regulatsioon tagada riigikaitseks vajaliku taristu ja tootmise ning väljaõppevõimekuse rajamist. Eelnõu kohaselt saab valitsus kaitseministri ettepanekul ja ohuhinnangu alusel määrata hoone riigikaitseliseks ehitiseks. Riigikaitselise ehitise eesmärk on tagada riigi julgeolek ja sõjaline kaitse. Riigikaitseliseks ehitiseks võib olla nii ministeeriumide valitsemisalas olev hoone kui ka strateegilist või sõjalist kaupa tootva ettevõtte tootmishoone. Riigikaitseliste ehitiste kavandamisel jäetakse ära planeerimismenetlus, keskkonnamõju hindamine ja metsateatise esitamine, mis tähendab, et sisuliselt saab ehitamisega alustada pärast loamenetluste, näiteks ehitus- ja keskkonnalubade ning kui tegemist on vastava alaga, siis ka Natura mõju hindamise, läbimist. Pooleliolevad planeeringud viiakse lõpuni senise korra alusel. Sama eriregulatsioon laieneb ka side- ja eelhoiatamissüsteemidele, sõjalise väljaõppega seotud rajatistele, harjutusväljadele ja lasketiirudele ning sõjaväelinnakute ja ladustamisega seotud ehitistele. Eelnõuga nähakse ette ka vaidluste kiirem lahendamine. Riigikaitseliste ehitistega seotud kohtuvaidlused tuleb lahendada eelisjärjekorras nelja kuu jooksul, erandjuhul kuni kuue kuu jooksul. Esialgset õiguskaitset saab edaspidi taotleda üksnes koos kaebuse, apellatsiooni või kassatsiooniga, mitte eraldi või abstraktselt. Vaidlustamine on võimalik juhul, kui esineb oht oluliseks keskkonnahäiringuks; subjektiivsete õiguste kaitse jääb alles. Kohalike omavalitsuste roll ruumiotsustes väheneb riigimaad puudutavate riigikaitseliste ehitiste puhul: valitsus saab peatada planeeringud ja määrata maa sihtotstarbe, kuid kohaliku omavalitsuse arvamust küsitakse alati.
