Summary
Eelnõuga võetakse üle EL-i liikmesriikides kaubamärgiõigust ühtlustav vastav direktiiv. Kehtivas õiguses kaotatakse nõue, et kaubamärgina kaitstav tähis peab olema graafiliselt kujutatav. Kaubamärk on tähis, mille abil on võimalik eristada ühe ettevõtja kaupu või teenuseid teiste ettevõtjate sarnastest kaupadest või teenustest. Eelnõu lihtsustab mittetraditsiooniliste kaubamärkide, nt heli-, multimeedia- ja hologramm-märkide kaitsmist, kuna neid on edaspidi võimalik patendiametile esitada ka heli- või videofailina. Kehtiva õiguse kohaselt aga peab iga kaubamärki olema võimalik kujutada graafiliselt. Kehtiva õiguse järgi kontrollib kaubamärgi registreerimise käigus Patendiamet, et ei esineks kaubamärgi registreerimist takistavaid absoluutseid (nt tähisel puudub eristusvõime või see on üksnes kirjeldav) või suhtelisi (nt varasema äravahetamiseni sarnase kaubamärgi olemasolu) keeldumisaluseid. Eelnõu järgi patendiamet edaspidi enam suhtelisi keeldumisaluseid ei kontrolli. Direktiivi nõuete täitmiseks viiakse apellatsioonikomisjon Justiitsministeeriumi juurest Patendiameti juurde. Kuna direktiiv nõuab, et komisjon asuks liikmesriigi tööstusomandi keskameti juures. Komisjon on sõltumatu organ, mis lahendab tööstusomandiga (kaubamärk, patent, tööstusdisainilahendus) seotud vaidlusi kohustusliku kohtueelse menetluse korras. Lisaks muudetakse apellatsioonikomisjoni ülesehitust. Senise kaheksaliikmelise komisjoni asemel nähakse ette kahest alalisest liikmest koosnev komisjon. Sarnaselt kehtiva süsteemiga lahendab komisjon ka edaspidi vaidlusi kolmeliikmelises koosseisus, kaasates vastava valdkonna eksperdina koosseisu täiendava liikme või liikmed. Eelnõu kohaselt laiendatakse ka komisjoni pädevust. Lisaks Patendiameti otsuste peale esitatud kaebustele ja kaubamärkide vaidlustamisavaldustele hakkab komisjon lahendama ka kaubamärgiomaniku ainuõiguse tühiseks või lõppenuks tunnistamise avaldusi ning teiste tööstusomandi esemete tühistamise avaldusi, mida praegu lahendavad maakohtud. Eelnõu kohaselt nähakse ette ka meetmed komisjoni menetluse kiiremaks ja tõhusamaks muutmiseks.
