Summary
Eesti allkirjastas konventsiooni detsembris 2025 Haagis koos 33 teise riigi ja Euroopa Liiduga. Ratifitseerimine on järgmine samm panna Venemaa vastutama agressiooniga tekitatud laastavate kahjude eest Ukraina riigile, elanikele, ettevõtetele ja keskkonnale. Loodava rahvusvahelise kahjunõuete komisjoni ülesanne on hinnata Venemaa agressiooniga põhjustatud kahjusid Ukrainas ja määrata kindlaks hüvitissummad, mis kuuluvad väljamaksmisele. Komisjon tegeleb registreeritud kahjunõuete sisulise kontrolli ja õiguspärasuse hindamisega. Konventsioon jõustub, kui selle on ratifitseerinud vähemalt 25 allakirjutanut. Komisjoni loomine on osa kolmeosalisest terviklikust rahvusvahelisest hüvitusmehhanismist. Esimene sammas on kahjude register, mis loodi 2023. aasta mais Euroopa Nõukogu raamistikus ja mis kogub ning registreerib kahjunõudeid koos tõenditega. Praeguseks on registrisse kantud üle 80 000 kahjunõuet 13 kategoorias. Teine sammas on nüüd loodav kahjunõuete komisjon, mis kontrollib registreeritud nõuete õiguspärasust ja määrab hüvitatavaid summasid. Kolmas samm on kompensatsioonifond, mis tuleb tulevikus luua ja mis hüvitab Ukrainale komisjoni kinnitatud nõuded. Protsess tugineb ÜRO Peaassamblee 2022. aasta resolutsioonile, mis kinnitab Venemaa kohustust hüvitada rahvusvahelise õiguse rikkumisega tekitatud kahju. Eesti on olnud mehhanismi üks eestvedajaid ja osalenud aktiivselt konventsiooni väljatöötamises. Konventsioon on avatud liitumiseks kõigile Euroopa Nõukogu liikmesriikidele ja teistele riikidele, kes toetasid ÜRO Peaassamblee vastavat resolutsiooni. Venemaa saab komisjoniga ühineda vaid juhul, kui ta tunnistab oma vastutust agressiooni eest ja nõustub kahjud hüvitama.
