Summary
Seadust muudetakse, et anda keskkonnaametile õigus kasutada riikliku järelevalve tegemisel eriolukordades lisaks füüsilisele jõule ka gaasirelva, külmrelva ja käeraudu. Seoses volituste laiendamisega nähakse keskkonnainspektoritele ette täiendav väljaõpe, mis koosneb nii baas- kui jätkukoolitustest. Praegu on keskkonnaametil salaküttimise ja kalastamise järelevalves õigus kasutada eriolukorras tulirelva. Eelnõu ei laienda tulirelva kasutamise õigust, see jääb ka edaspidi üksnes jahi-, metsa-, kalapüügi- ja lennundusseaduse alusel tehtava riikliku järelevalve juurde. Eelnõuga lahendatakse probleemi, kus igapäevases töös inspektoril abivahendeid ei ole. Erikoolituse läbides saavad nad õiguse kasutada nii gaasi kui külmrelva. Keskkonnaametis töötab 132 keskkonnainspektorit. Muudatuse eesmärk on tagada nende turvalisus ja anda neile piisavad vahendid keskkonnale tõsist kahju tekitavatele rikkumistele reageerimiseks. Näiteks olukordades, kui tuleb katkestada ohtlike jäätmete põletamine, reovee vette või ohtlike ainete pinnasesse laskmine. Inspektoritel peab olema võimalus viivitamatult reageerida, rikkumine lõpetada ja rikkuja kinni pidada. Gaasi- või külmrelva saab kasutada äärmise meetmena, kui muud abinõud ei anna tulemust.
