Summary
Eelnõu näeb ette seaduse ajakohastamise, et vähendada tööandjate ja Tööinspektsiooni halduskoormust ning muuta tööohutuse süsteem selgemaks ja tõhusamaks. Muudatustega kaotatakse dubleerivad kohustused ja vähendatakse aruandlust, säilitades samal ajal töötajate ohutuse. Eelnõuga tehakse mitmeid olulisi muudatusi. Näiteks ei pea enam alla 10 töötajaga ettevõtted esitama töökeskkonna riskianalüüsi Tööinspektsiooni iseteenindusse (TEIS) ega korraldama töötervishoiu olukorra analüüsi. Ühe inimese ettevõtetele ei kohaldu seadus täies mahus. Väheneb bürokraatia – kaob kohustus teavitada Tööinspektsiooni töökeskkonnaspetsialistist ja -volinikust. Töökeskkonnavolinik valitakse edaspidi vaid töötajate soovil (vähemalt 10%). Paindlikum töökorraldus – esmaabi saab korraldada ühiselt mitme ettevõtte peale, eraldi esmaabiandjat ei pea igal tööandjal olema. Selgemad reeglid joobekontrolliks – tööandjal on õigus kontrollida töötaja joovet tööohutuse tagamiseks põhjendatud kahtluse korral või kõrgendatud riskiga töödel. Lisaks muutub tööinspektsiooni järelevalve andmepõhisemaks ja sihipärasemaks. Inspektsioon saab õiguse kasutada töötamise registri (TÖR) ja töövõtuahela andmeid, mis aitab paremini tuvastada varjatud töid ja rikkumisi, eelkõige ehitussektoris. Samal ajal väheneb formaalne kontroll ning fookus liigub suurema riskiga töökohtadele. Muudatuste tulemusel väheneb ettevõtjate halduskoormus, paraneb õigusselgus ning tööohutuse korraldus muutub paindlikumaks. Töötajatele uusi kohustusi ei lisandu ning tööohutuse tase säilib.
