Summary
Muudatuse eesmärk on tagada, et lapsele osutatav abi lähtuks tema tegelikest vajadustest ja huvidest ning et abi osutamine oleks koordineeritud ja läbipaistev. Muudatused aitavad paremini kaitsta abivajava lapse õigusi, sealhulgas last puudutavate kohtulahendite täitmisel. Edaspidi eristatakse senisest selgemalt olukordi, kus sekkumine eeldab KOVi lastekaitsetöötaja juhtivat rolli, ning juhtumeid, kus lapse heaolu toetamine saab toimuda eelkõige selles valdkonnas, kus lapse raskused ilmnesid (nt tervishoid, haridus, pere). Eelnõuga muudetakse lastekaitsetöötaja poolt lastekaitselise juhtumikorralduse algatamise aluseid, vähendades seeläbi lastekaitsetöötajate töökoormust. See aitab vähendada spetsialistide läbipõlemist ning toetab keskendumist lastele, kes vajavad lastekaitsetöötaja tuge kõige enam. Lisaks täpsustatakse eelnõuga lastekaitsetöötaja ülesandeid abivajava lapse abivajaduse hindamisel ja talle abi osutamisel, sealhulgas lapse üleandmise ja lapsega suhtlemise võimaldamisega seotud täitemenetlustes. TMSis tehtavate muudatustega täpsustatakse ka kohtutäituri ja politsei rolle sellistes täitemenetlustes ning luuakse alus täitetoimingu peatamiseks olukordades, kus selle jätkamine võib kahjustada lapse heaolu.
