Summary
Eelnõu näeb ette vabastada Priit Pikamäe Riigikohtu esimehe ametist alates 4. veebruarist 2019 omal soovil seoses tema nimetamisega Vabariigi Valitsuse poolt Euroopa Kohtu kohtujuristi kandidaadiks. Seletuskirjas märgitakse, et lähtuvalt kohtute seaduse § 581 lõikest 1 ei vabastata kohtunikku tema töötamisel rahvusvahelises kohtuinstitutsioonis kohtuniku ametist, vaid kohtuniku volitused ja teenistussuhe Eesti Vabariigi kohtunikuna peatuvad. Seega säilib Priit Pikamäel õigus pärast Euroopa Kohtu kohtujuristi ametiaja lõppemist pöörduda tagasi Riigikohtu kohtunikuks Riigikohtus vaba kohtunikukoha olemasolul.
