Le II de l’article L442‑1 du code de commerce est complété par un alinéa ainsi rédigé : « La responsabilité de son auteur peut également être engagée lorsque la réduction significative des commandes, intervenue dans le cadre de la négociation ou de l’exécution des accords prévus à l’article L441‑3, ne repose sur aucune justification objective et a pour effet de contraindre le partenaire à accepter des conditions commerciales non librement négociées. »
