L’article 373‑2‑9 du code civil est complété par un alinéa ainsi rédigé : « Lorsque l’enfant exprime un refus de se rendre chez l’un de ses parents en invoquant des violences sexuelles ou intrafamiliales, ce refus est recueilli dans des conditions adaptées à son âge et à son degré de maturité et fait l’objet d’une prise en compte spécifique dans l’appréciation de son intérêt. »
