Mrs Gabrielle Cathala questions the Minister for Europe and Foreign Affairs on the restitution of the proceeds of ill-gotten assets by Mr Rifaat al-Assad in order to finance cooperation and development actions in Syria. Par la loi du 4 août 2021 de programmation relative au développement solidaire et à la lutte contre les inégalités mondiales, la France a mis en place un dispositif de restitution des « biens mal acquis ». Ce dispositif est placé sous la tutelle du ministère de l'Europe et des affaires étrangères (MEAE). Il prévoit la restitution des sommes issues de la vente des « biens mal acquis » confisqués par les autorités françaises, sous forme de projets de coopération et de développement dans les pays concernés et au plus près des populations civiles et de leurs besoins. Les projets sont étudiés au cas par cas en fonction des conditions particulières de chaque société et ont pour objectif de contribuer à l'amélioration des conditions de vie des populations. Dans le cas syrien, la confiscation du patrimoine de Rifaat al-Assad a été rendue définitive par décision de la Cour de cassation le 7 septembre 2022. A la suite de la chute du régime autoritaire de Bachar al-Assad le 8 décembre 2024, le MEAE a entamé un dialogue avec les autorités de transition syriennes et la France est engagée à leurs côtés pour contribuer au relèvement économique de la Syrie et à sa reconstruction, à l'amélioration de la situation humanitaire et à la stabilisation régionale. Dans ce contexte, des discussions ont été initiées avec les autorités syriennes de transition sur l'utilisation des revenus issus de la vente des biens confisqués pour contribuer, de manière coordonnée avec les autorités syriennes de transition, au relèvement de la Syrie. La France travaille de près avec les acteurs de la société civile syrienne et les ONG françaises. Depuis 2018, l'engagement de la France auprès de la population syrienne est resté constant, à hauteur de 50 millions d'euros annuels minimum, en lien avec nos partenaires, ONG locales, françaises et internationales ainsi que les agences des Nations unies. En 2025, malgré la réduction du budget alloué à l'aide humanitaire, plus de 50 millions ont été engagés par le MEAE pour le financement de projets humanitaires et de stabilisation. En 2026, le MEAE continuera de soutenir la mise en œuvre d'actions humanitaires au bénéfice de la population, en fonction des moyens qui seront alloués à l'aide humanitaire.
