Summary
Mrs Claire O'Petit draws the attention of the Minister of Agriculture and Food to the situation of animals during long transports. This summer 2017, the press reported on the ordeal of animals exported to Africa or the Middle East, the number of which has increased significantly over the last two years. This increase probably results from the creation of the “France Viande Export” platform aimed at facilitating partnerships economic with importing countries. However, long-distance transport of live animals in poor conditions can influence the risk of transmission and spread of diseases as well as the quality of products. Consequently, it is not only a question of protecting the well-being of the animal even if it is now “a living being endowed with sensitivity” (article L. 515-14 of the civil code). In addition, the regulation 1/2005 of the Council on the protection of animals during transport provides that more restrictive national measures can be enacted in order to improve animal welfare. Thus, Member States such as Germany, the Netherlands, Ireland and Slovenia have adopted more protective legislation. In France, according to the 2015 Food and Veterinary Office report, the situation is “particularly unsatisfactory” with “hundreds of animals not fit for transport arriving in slaughterhouses accompanied by certificates issued by private practitioners attesting to their suitability”. Furthermore, in its judgment of April 23, 2015, the CJEU specifies that this protection does not stop at the borders of the Member State and that, therefore, the national authorities must ensure compliance with Regulation 1/2005 until the final destination by the transport manager. Also, she asks him what he plans to do to improve the transport conditions of animals intended for intra-community deliveries but also for exports.
