Summary
Ms. Danielle Brulebois draws the attention of the Minister of Solidarity and Health to the social contributions of the majority manager of an SARL in liquidation. Despite the declaration of the judicial liquidation of the SARL by the commercial court, sometimes significant contributions must still be paid to the RSI (social regime for the self-employed) which poses great difficulties for the manager without income. This state of affairs has for origin the order of March 12, 2014 which stipulates that the legal personality of a company in liquidation is extended until the judgment of closure for insufficient assets (art. 1844-7-7 of the civil code). This judgment often only occurs 9 to 15 months after the liquidation is pronounced. She therefore wishes to know the Government's position on this state of affairs and asks if measures are possible to put an end to these calls for contributions as soon as the judicial liquidation is pronounced with cessation of activity.
