Summary

Ms. Amélia Lakrafi draws the attention of the Minister of the Economy and Finance to the difficulties encountered by many French people established outside France in fully and effectively asserting their right to have a bank account. The toughening of the fight against fraud and the financing of terrorism - which has undergone various legislative translations in recent years - has led to certain French banks to unexpectedly close the accounts of their customers residing abroad. To deal with this phenomenon which is likely to pose very concrete problems in the daily lives of the people concerned, a real effort has been made by the competent authorities to facilitate and simplify access to the procedure for activating the right to an account. The Banque de France, very proactive on this subject, has notably set up a dematerialized device, which has produced positive effects. However, from what she was able to observe very directly, certain obstacles remain. In particular, users struggle to provide a refusal to open an account, issued in due form by a banking establishment. Either the refusal is only notified to them orally, or the written notification does not include all the required information. So she had to accompany the case of a person having been given a refusal certificate not showing their name. However, this proof is absolutely necessary for the activation of the right to the account by the Banque de France. In light of these elements which indicate concrete difficulties encountered on the ground, she would like to know the measures that the Government plans to take to encourage banks to respect their obligations of issuing a certificate of refusal to open an account in due form, and thus allowing the right to an account to be exercised more fluidly.
