Summary

Mr. Joël Giraud draws the attention of the Minister of the Economy and Finance to the situation of beneficiaries of the disabled adult allowance (AAH) with regard to their conditions of access to bank loans. Despite the planned increase of 90 euros in the AAH from November 2019, the living conditions and purchasing power of people with disabilities remain precarious for a very large number of them. Only 43% of people recognized as disabled are active in France, including 35% employed and 8% unemployed. They are three times less likely to be employed than non-disabled people with the same characteristics, and twice as likely to be unemployed. As a result, many people with disabilities do not have access to credits granted by financial institutions, particularly for consumption, due to lack of recognized resources. In the state of the law, it is indicated that lenders must carry out a “rigorous assessment” of the borrower’s solvency, based on “information relating to 1° The borrower’s income, savings and assets” (article R. 312-0-5 of the Consumer Code). Also, he asks him to kindly let him know if it could be considered to complete the system by introducing a reference to the AAH (or, more generally, to social minima) by indicating, for example, that the allowance for disabled adults is, where applicable, taken into account in the borrower's income by regulatory modification.
