Summary

Mrs Alexandra Valetta Ardisson draws the attention of the Minister of the Interior to the implementation of the post-parking package (FPS) and its consequences on the implementation of the latter and on the damaging economic impacts which weigh on shared mobility operators. Indeed, until January 1, 2018, vehicle rental companies had the possibility, in the event of a parking fine, to designate the responsible tenant. However, with the entry into force of the law for the modernization of territorial public action and the affirmation of metropolises (MAPTAM law), these companies must first pay the FPS regulation and then turn against the tenant in order to recover the amount. This unprecedented situation is detrimental for the sustainability of rental companies and for customers, because current legislation does not allow operators to transfer the responsibility for payment of the FPS falls on the actual driver of the vehicle, who, therefore, can no longer contest the validity of the fine claimed. Consequently, she asks him to kindly clarify the Government's intentions in order to consolidate the existence of these companies and to kindly inform him of the terms of contesting the fines for the customers of car rental companies in the event of a complaint from the FPS.
