Article L. 174-6 of the town planning code, amended by article 34 of law no. 2018-1021 of November 23, 2018 on the development of housing, development and digital technology, known as the Elan law, limits to 24 months the duration of reinstatement of land use plans (POS) following the cancellation or declaration of illegality of a local plan of town planning (PLU), a town planning document in place of it or a municipal map involved after December 31, 2015. During these 24 months, the POS cannot be subject to any change procedure. In the absence of transitional provisions, these provisions are of immediate application. SOPs reinstated for more than 2 years are therefore obsolete on the date of promulgation of the law and uncompleted development procedures cannot be continued. It is therefore appropriate, in such a scenario, to quickly approve a purged PLU defects leading to its cancellation or declaration of illegality.
