Summary
Ms. Lise Magnier draws the attention of the Minister of the Interior to the implementation of the post-parking package (FPS) and its damaging organizational and economic consequences which are currently weighing on shared mobility operators. Whereas previously rental companies were able to designate the tenant responsible for the parking fine, they now have to pay the FPS to then turn against the tenant in order to recover the amount. Current legislation does not allow mobility operators to transfer, in the context of their activity, the responsibility for paying the FPS to the actual driver of the vehicle. Indeed, the automatic passing on of the customer's FPS charge cannot be introduced into the general conditions of rental contracts because it would be qualified as abusive regarding the right to consumption. If a compulsory prior administrative appeal procedure (RAPO) is possible, it generates additional costs linked to the reissue of the FPS that the municipalities, EPCI or mixed union cannot bear. The financial consequences are considerable for shared mobility companies. This is why she asks him that this situation finds a legislative solution in order to re-establish a mechanism for designating the responsible tenant.
