Mr. Olivier Gaillard draws the attention of the Minister of Solidarity and Health to the difficult situation of women victims of the Essure definitive sterilization device produced by the Bayer laboratory. Essure implants, 4 cm metal implants inserted into the fallopian tubes, locally create an inflammatory reaction (fibrosis) aimed at obstructing them, thus preventing any fertilization. These springs are made of metals heavy allergens (nickel, titanium, chromium, iron, tin, platinum, iridium) and PET fibers (polyethylene terephthalate - endocrine disruptors in certain conditions). On September 18, 2017, the German pharmaceutical laboratory Bayer HealthCare announced that it was ending the marketing of these contraceptive implants in France. If this decision was urgent and necessary, the laboratory Bayer has not provided any removal protocol for women with the device, forcing them to undergo major surgery to extract these implants. The lack of training of certain gynecological surgeons sometimes requires multiple surgical interventions (with general anesthesia and invasive surgical procedures). The RESIST association (mutual aid, support and information network on tubal sterilization), approved by the Ministry of Health which supports women victims of these implants, requested the establishment of Essure reference centers, access to rigorous training for obstetric surgeons in explantation and, above all, the creation of a central compensation system entrusted to ONIAM and dedicated to the examination of these very numerous cases. Indeed, the judicial system is not able to absorb such litigation. : expert assessment procedures are necessarily individual, long, complex and very costly for victims who must deposit large sums for expert fees.
