Summary
Ms. Sabine Rubin draws the attention of the Minister of National Education and Youth to the failure to take into account children enrolled in the Localized Units for Educational Inclusion (ULIS) in the enrollment criteria defining the threshold for maintaining, creating, or removing classes in nursery and primary schools. Law No. 2005-102 of February 11, 2005 for equal rights and opportunities, the participation and citizenship of people with disabilities guarantees the right of any child “with a disability or disabling health problem to be enrolled in a school in an ordinary environment”. Equality among all schoolchildren should be a basic principle; but this is not the case. The accounting of children covered by a ULIS in school map projects is inconsistent. They are not taken into account and are distributed in their reference class for the logical purpose of the education of students with disabilities. This non-accounting contributes to the closure or non-opening of a class. Many schools will undergo class cuts in order to meet the objective of doubling CP and CE1 to 12. At the same time, non-REP kindergarten, CE2, CM1, CM2 and CP/CE1 classes will see their numbers increase sharply at 28, 30, even 32 students. These projections do not take into account uncounted ULIS students. A CM1 in REP could therefore have 30 students + 2 students from ULIS. In schools that have a ULIS, some will lose a class because the closure threshold does not take into account students with disabilities. Other schools will not be able to open additional classes because the opening threshold does not take into account ULIS students. He Teachers are therefore asked to include ULIS students without counting them in the numbers in their reference class. She would like to know what measures he intends to take to put an end to this discrimination against ULIS students which tends to count them twice: as students “with a disability or health problem” and as “ordinary class” students and so that the closing thresholds and aperture are no longer adjusted according to this double counting.
